Defining Murder

Each state defines homicide differently, so it’s important to make sure that you’re working with the right set of definitions.

There are generally four kinds of criminal homicide:

  • Capital murder
  • Murder
  • Intoxication Manslaughter
  • Manslaughter

Capital murder is reserved for the worst cases, usually involving an aggravating factor that the state considers especially dangerous or morally heinous. Capital murder cases are eligible for the death penalty.

Manslaughter, meanwhile, is a lighter charge than murder. It’s reserved for cases where the state can’t prove that the defendant intended to kill anyone but, rather, that the defendant’s reckless behavior caused a death. Intoxication manslaughter applies specifically to drunk driving deaths.

The bulk of this web page will center on the second item in the list above, the murder charge.

Murder is defined as knowingly and intentionally causing the death of another person or committing an act that is clearly dangerous to human life while intending to cause serious bodily injury, and such injury causes death to another person.

The intent element is key. The prosecution must be able to prove beyond a reasonable doubt that you intended to kill the victim (or that you intended to cause serious bodily injury while clearly endangering his or her life).

While we have many legal defenses available to us as murder defense lawyers, it is this intent element that often proves debilitating to the prosecution’s case. Remember: The state has the burden of proof.

What Are the Penalties for Murder?

Murder is classified as either a first-degree or second-degree felony, depending on the circumstances of your case. In either scenario, the consequences are severe. Those convicted of first-degree murder could spend the rest of their lives in prison.
