Experienced Attorneys Fighting DUI Convictions in Dallas, TX
Anyone who drives on public roadways while clearly intoxicated poses an obvious danger to themselves and everyone else. The State of Texas is especially concerned, though, about young people who drive while drunk.
That’s why Texas created a statute specifically designed to crack down on drunk driving by people under the age of 21: DUI (Driving Under the Influence). Conviction for DUI carries strong penalties, designed to discourage the behavior in the future.
But in reality, DUI charges aren’t motivated by safety concerns alone. Police are under pressure to arrest as many people on drunk driving charges as they can. Indeed, Dallas police are known for being especially tough on drunk driving, and young people are common targets.
The problem is that the tests used to “prove” intoxication are extremely unreliable. The state would love for courts to accept these test results as universally authoritative, but the technology simply isn’t there.
As Dallas DUI defense lawyers, it is our position that, before the state ruins a young person’s reputation and restricts his or her freedom, it should be held to the very highest legal standards.
After all, the DUI statute is already very tough in Texas, as we will see below. The government enjoys an upper hand in these cases, too. That’s why defendants need the best available legal defense on their side.

Understanding the DUI Charge in Texas
Texas uses two different basic drunk driving charges: DWI and DUI.
- DWI, or Driving While Intoxicated, is typically charged against adult drivers who have a blood alcohol content (BAC) of 0.08 or higher.
- DUI, or Driving Under the Influence, applies exclusively to drivers under the age of 21.
Texas maintains a “zero tolerance” policy for drunk driving among young people, so the BAC rules are very different with DUI.
In fact, any detectable amount of alcohol is sufficient to support conviction. It is even common for officers to issue tickets merely because they think they smell alcohol on the young driver’s breath.
As with most other “zero tolerance” policies, the DUI law in Texas frequently produces unfair results. After all, if field sobriety tests can’t accurately detect higher levels of BAC in DWI cases, they certainly can’t be trusted to yield reliable results in a zero-tolerance DUI system.
The courts simply should not be asked to trust a mere blip on a BAC test when those blips are so frequently wrong.
The experienced Dallas DUI defense lawyers at Oberheiden, P.C. can help you and your family fight back against unfair and unfounded DUI charges.
Penalties for DUI in Texas
Texas imposes slightly lighter penalties for DUI than DWI, but for a young person at the relative beginning of his or her adult life, the consequences can still be quite serious.
Generally speaking, DUI is a Class-C misdemeanor in Texas. Penalties include:
- $500 fine
- Suspended driver’s license upon citation or arrest
- Misdemeanor criminal record
A DUI conviction can negatively affect a young person’s educational opportunities and employment prospects for the future. Even worse, it can stain reputations for a long time to come.
Making matters worse, DUI charges can also trigger spikes in your family’s auto insurance premiums.
There is hope against DUI charges in Texas, though. They can be defeated. Your best chance is with our aggressive Dallas DUI defense lawyers on your side.
