Understanding the DUI Charge

Two different basic drunk driving charges: DWI and DUI.

  • DWI, or Driving While Intoxicated, is typically charged against adult drivers who have a blood alcohol content (BAC) of 0.08 or higher.
  • DUI, or Driving Under the Influence, applies exclusively to drivers under the age of 21.

Maintains a “zero tolerance” policy for drunk driving among young people, so the BAC rules are very different with DUI.

In fact, any detectable amount of alcohol is sufficient to support conviction. It is even common for officers to issue tickets merely because they think they smell alcohol on the young driver’s breath.

As with most other “zero tolerance” policies, the DUI law frequently produces unfair results. After all, if field sobriety tests can’t accurately detect higher levels of BAC in DWI cases, they certainly can’t be trusted to yield reliable results in a zero-tolerance DUI system.

The courts simply should not be asked to trust a mere blip on a BAC test when those blips are so frequently wrong.

Penalties for DUI

The state imposes slightly lighter penalties for DUI than DWI, but for a young person at the relative beginning of his or her adult life, the consequences can still be quite serious.

Generally speaking, DUI is a Class-C misdemeanor. Penalties include:

  • $500 fine
  • Suspended driver’s license upon citation or arrest
  • Misdemeanor criminal record
